BOARDING AGREEMENT
This agreement, dated the ______ day of __________, 20___, is between Trademark Stables, LLC. with its principle office located at 2437 Olive Chapel Rd., Apex, NC27502, hereinafter called "Trademark Stables", and whose address is 2437 Olive Chapel Rd., Apex, NC27502 and telephone number is (919) 349-1533, hereinafter called "Owner".
1. FEES, TERM AND LOCATION: In consideration of $475.00 upper barn / $525 lower barn per horse per month paid by the Owner in advance, Trademark Stables agrees to board the hereinafter described horse(s) at Trademark Stables located at 2437 Olive Chapel Rd., Apex, NC27502, commencing on _________________, on a month to month basis. $35 discount for payment made before the 1st of the month, $35 late fee after the 7th of the month.
2. DESCRIPTION: The horse(s) to be boarded is (are) as follows:

3. FEED AND FACILITIES: Trademark Stables agrees to provide normal and reasonable care,
including grain, hay and water, necessary to maintain the health and well being of the horse(s).
Trademark Stables will provide a stall for said horse(s), pasture or paddock turnout on a daily
basis, and use of facilities. Horses that are on a daily wormer will be wormed with Ivermectin
Gold paste spring and fall at an additional cost to boarder. Horses that are on a regular paste
wormer rotation will be wormed every 6-8 weeks, including Ivermectin Gold Spring and Fall, at
an additional cost to the boarder. Cost is $15 per worming.
4. EXERCISE, BLANKETING, AND SPECIAL SERVICES: The Owner shall be solely responsible for the exercise and grooming of the horse(s). Trademark Stables provides blanketing services at an additional cost.
5. SPECIAL INSTRUCTIONS TO TRADEMARK STABLES: List any special instructions,
including by not limited to special medical and/or shoeing information, to Trademark Stables with
regard to the care of the horse(s).
6. HORSE EMERGENCY CONTACT AND/OR INSURANCE INFORMATION: List emergency
telephone numbers and/or insurance information if applicable.

7. RISK OF LOSS: During the time that the horse(s) is (are) in the custody of Trademark Stables,
Trademark Stables / Jennifer Lafforthun shall not be liable for any sickness,
disease, theft, death, or injury which may be suffered by the horse(s) or any other cause of action, whatsoever, arising out of being connected in any way with the boarding of said horse(s). This includes, but is not limited to, any personal injury or disability the horse may receive while on
Trademark Stables premises. The Owner fully understands that Trademark Stables does not carry any insurance on any horse not owned by it and that all risks connected with boarding or for any other reason for which the horse is on the premises of Trademark Stables are to be borne by the Owner. Trademark Stables / Jennifer Lafforthun shall not be liable for any loss of equipment, trailers or any other item stored at said location.
8. HOLD HARMLESS: Owner shall defend, indemnify and hold Trademark Stables/Jennifer
Lafforthun harmless from and against any claim, loss, expense or damage to any
person, or property owned by Trademark Stables / Jennifer Lafforthun, or any other person, agent, employee or invitee of Trademark Stables/Jennifer Lafforthun or Owner, arising out of the
placement of said horse(s) upon Trademark Stables property, including the cost associated with or necessitated by litigation and specifically including attorney's fees incurred by Trademark
Stables/Jennifer Lafforthun as a result of litigation.
9. EMERGENCY CARE: Trademark Stables agrees to attempt to contact Owner should Trademark Stables feel that medical treatment is needed for said horse(s) but, if Trademark Stables is unable to contact the Owner, Trademark Stables is then authorized to secure emergency veterinary and/or blacksmith care required for the health and well-being of said horse(s). All costs of such care secured shall be paid by the Owner.
10. OWNERSHIP - COGGINS TEST: Owner warrants that he owns said horse(s) and will provide, prior to the time of delivery of said horse(s) to Trademark Stables, proof satisfactory of a current negative Coggins test and an up-to-date record of vaccinations and wormings.
11. TERMINATION AND NOTICE: This agreement constitutes a month to month tenancy and
either party may terminate this agreement by giving the other party thirty (30) days notice in
writing. Notice shall be given by mail to the address of the parties as stated herein.
12. RIGHT OF LIEN: The Owner is put on notice that Trademark Stables has a right of lien, as set forth in Chapter 44A of the General Statutes of North Carolina, for the amount due for the board and keep such horse(s) and shall have the right, in accordance with statutory provision, to retain the said horse(s) until the amount of indebtedness is paid in full.
This BOARDING AGREEMENT shall be governed under the laws of the State of North Carolina. The parties hereto have executed this agreement the day and year first written.
